1. Agreement to Terms
These Terms and Conditions ("Terms") govern your use of services provided by Superior Draft Beer Service, LLC ("Company," "we," "us," or "our") and your use of our online client portal. By scheduling services, providing your contact information, or using our portal, you agree to be bound by these Terms.
2. Services
Superior Draft Beer Service, LLC provides draught beer line cleaning and maintenance services to licensed establishments in Ohio. Our services include:
- Recirculating chemical cleaning of draught beer lines using industry-standard food-grade sanitizers
- Flushing and rinsing of beer lines, faucets, couplers, and associated equipment
- Visual inspection and documentation of draught system components
- Cleaning records sufficient to meet Ohio liquor control authority requirements
Service appointments are scheduled on a recurring or as-needed basis by mutual agreement. You are responsible for ensuring that a representative is available at the time of service and that our technician has access to the draught system.
3. Payment Terms
The following payment terms apply to all services rendered:
- Invoices are due on receipt. Invoices are generated following each service visit and become payable immediately upon delivery.
- Prepaid balance system. Customers may maintain a prepaid credit balance on their account. Prepaid balances are applied automatically to new invoices as they are generated. Prepaid balances are non-refundable except at the sole discretion of the Company.
- 3% card processing fee. A 3% processing fee applies to all credit and debit card payments to cover payment processor costs. Payments made by cash or check are not subject to this fee.
- $35 returned check fee. A $35 returned check fee will be assessed for any check that is returned unpaid by your bank for any reason.
We reserve the right to suspend service to accounts with outstanding balances.
4. SMS Consent
By providing your phone number to Superior Draft Beer Service, you consent to receive transactional SMS messages from us related to your account, including portal setup notifications, invoice delivery, and payment links. These are service messages, not marketing.
- Reply STOP to any message to opt out at any time.
- Message and data rates may apply, depending on your mobile carrier plan.
- Message frequency varies based on account activity.
Opting out of SMS messages does not affect your ability to receive invoices and communications by email or to access your client portal. For full details on how we handle phone numbers and SMS, see our Privacy Policy.
5. Equipment and Third-Party Property
Our cleaning services are performed on draught beer dispensing equipment owned or operated by you or by your landlord or equipment lessor. We do not own, install, sell, or warranty any draught system equipment.
We make no warranties, express or implied, regarding the condition, fitness, merchantability, or performance of any third-party equipment. Our cleaning service does not include repair, replacement, or modification of any equipment component. We are not responsible for pre-existing equipment defects, normal wear, or failure of any component, whether discovered during or after a service visit.
If our technician identifies a component that appears damaged or likely to fail, we will notify you, but we are under no obligation to perform repairs. Any repairs or equipment replacements are your responsibility.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Superior Draft Beer Service, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services, including but not limited to lost profits, loss of use, product loss, or equipment damage caused by pre-existing conditions.
Our total liability for any claim arising from a single service visit shall not exceed the amount paid for that specific service visit.
7. Compliance
You are solely responsible for ensuring that your establishment holds all required licenses and permits for the sale and service of alcoholic beverages, and for complying with all applicable state and local regulations. We will provide cleaning records that document the services we performed, but we do not guarantee that our services satisfy any particular regulatory requirement.
8. Termination
Either party may terminate the service relationship at any time by providing reasonable written or verbal notice. You remain responsible for all charges incurred for services performed prior to termination, and any outstanding invoices become immediately due.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami County, Ohio.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
